DATA PROTECTION NOTICE

This Data Protection Notice (“Notice”) sets out the basis which ZEE & ELLE LLP (“we”, “us”, or “our”) may collect, use, disclose or otherwise process personal data of our customers in accordance with the Personal Data Protection Act (“PDPA”). This Notice applies to personal data in our possession or under our control, including personal data in the possession of organisations which we have engaged to collect, use, disclose or process personal data for our purposes.

PERSONAL DATA

1. As used in this Notice:

“customer” means an individual who (a) has contacted us through any means to find out more about any goods or services we provide, or (b) may, or has, entered into a contract with us for the supply of any goods or services by us; and

“personal data” means data, whether true or not, about a customer who can be identified: (a) from that data; or (b) from that data and other information to which we have or are likely to have access.

2. Depending on the nature of your interaction with us, some examples of personal data which we may collect from you include your name and identification information such as your NRIC number, contact information such as your address, email address or telephone number, nationality, gender, date of birth, marital status, photographs and other audio-visual information, employment information and financial information such as credit card numbers, debit card numbers or bank account information.

3. Other terms used in this Notice shall have the meanings given to them in the PDPA (where the context so permits).

COLLECTION, USE AND DISCLOSURE OF PERSONAL DATA

4. We generally do not collect your personal data unless (a) it is provided to us voluntarily by you directly or via a third party who has been duly authorised by you to disclose your personal data to us (your “authorised representative”) after (i) you (or your authorised representative) have been notified of the purposes for which the data is collected, and (ii) you (or your authorised representative) have provided written consent to the collection and usage of your personal data for those purposes, or (b) collection and use of personal data without consent is permitted or required by the PDPA or other laws. We shall seek your consent before collecting any additional personal data and before using your personal data for a purpose which has not been notified to you (except where permitted or authorised by law).

5. We may collect and use your personal data for any or all of the following purposes:

(a) performing obligations in the course of or in connection with our provision of the goods and/or services requested by you;

(b) verifying your identity;

(c) responding to, handling, and processing queries, requests, applications, complaints, and feedback from you; 

(d) managing your relationship with us;

(e) processing payment or credit transactions; 

(f) sending your marketing information about our goods or services including notifying you of our marketing events, initiatives and promotions, lucky draws, membership and rewards schemes and other promotions;

(g) complying with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority; 

(h) any other purposes for which you have provided the information;

(i) transmitting to any unaffiliated third parties including our third party service providers and agents, and relevant governmental and/or regulatory authorities, whether in Singapore or abroad, for the aforementioned purposes; and

(j) any other incidental business purposes related to or in connection with the above.

6. We may disclose your personal data:

(a) where such disclosure is required for performing obligations in the course of or in connection with our provision of the goods or services requested by you; or

(b) to third party service providers, agents and other organisations we have engaged to perform any of the functions listed in clause 5 above for us.

7. The purposes listed in the above clauses may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).

WITHDRAWING YOUR CONSENT

8. The consent that you provide for the collection, use and disclosure of your personal data will remain valid until such time it is being withdrawn by you in writing. You may withdraw consent and request us to stop using and/or disclosing your personal data for any or all of the purposes listed above by submitting your request in writing or via email to our Data Protection Officer at the contact details provided below.

9. Upon receipt of your written request to withdraw your consent, we may require reasonable time (depending on the complexity of the request and its impact on our relationship with you) for your request to be processed and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us. In general, we shall seek to process your request within ten (10) business days of receiving it.

10. Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing our goods or services to you and we shall, in such circumstances, notify you before completing the processing of your request. Should you decide to cancel your withdrawal of consent, please inform us in writing in the manner described in clause 8 above.

11. Please note that withdrawing consent does not affect our right to continue to collect, use and disclose personal data where such collection, use and disclose without consent is permitted or required under applicable laws.

ACCESS TO AND CORRECTION OF PERSONAL DATA

12. If you wish to make (a) an access request for access to a copy of the personal data which we hold about you or information about the ways in which we use or disclose your personal data, or (b) a correction request to correct or update any of your personal data which we hold about you, you may submit your request in writing or via email to our Data Protection Officer at the contact details provided below.

13. Please note that a reasonable fee may be charged for an access request. If so, we will inform you of the fee before processing your request. 

14. We will respond to your request as soon as reasonably possible. Should we not be able to respond to your request within thirty (30) days after receiving your request, we will inform you in writing within thirty (30) days of the time by which we will be able to respond to your request. If we are unable to provide you with any personal data or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under the PDPA).

PROTECTION OF PERSONAL DATA

15. To safeguard your personal data from unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks, we have introduced appropriate administrative, physical and technical measures such as up-to-date antivirus protection, encryption and the use of privacy filters to secure all storage and transmission of personal data by us, and disclosing personal data both internally and to our authorised third party service providers and agents only on a need-to-know basis.

16. You should be aware, however, that no method of transmission over the Internet or method of electronic storage is completely secure. While security cannot be guaranteed, we strive to protect the security of your information and are constantly reviewing and enhancing our information security measures.

ACCURACY OF PERSONAL DATA

17. We generally rely on personal data provided by you (or your authorised representative). In order to ensure that your personal data is current, complete and accurate, please update us if there are changes to your personal data by informing our Data Protection Officer in writing or via email at the contact details provided below.

RETENTION OF PERSONAL DATA

18. We may retain your personal data for as long as it is necessary to fulfil the purpose for which 

it was collected, or as required or permitted by applicable laws. 

19. We will cease to retain your personal data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal data was collected, and is no longer necessary for legal or business purposes.

TRANSFERS OF PERSONAL DATA OUTSIDE OF SINGAPORE

20. We generally do not transfer your personal data to countries outside of Singapore. However, if we do so, we will obtain your consent for the transfer to be made and we will take steps to ensure that your personal data continues to receive a standard of protection that is at least comparable to that provided under the PDPA.

EFFECT OF NOTICE AND CHANGES TO NOTICE

22. This Notice applies in conjunction with any other notices, contractual clauses and consent clauses that apply in relation to the collection, use and disclosure of your personal data by us.

23. We may revise this Notice from time to time without any prior notice. You may determine if any such revision has taken place by referring to the date on which this Notice was last updated. Your continued use of our services constitutes your acknowledgement and acceptance of such changes.

PRIVACY STATEMENT

SECTION 1 - HOW WE MANAGE YOUR PERSONAL INFORMATION

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

SECTION 2 - CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at zeeandellesg@gmail.com

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECTION 6 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 7 - COOKIES

Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.

_session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).

_shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits

_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.

cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.

_secure_session_id, unique token, sessional

storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

SECTION 8 - AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

SECTION 9 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

FAQs about Our Cake Shop

Ordering

We have a rotational selection of whole cakes and sliced cakes available daily at all outlets. You may drop us a call to check what is available, or simply walk-in to purchase. If you wish to reserve before coming down, you can do so on our On Demand website here.

If a certain date/time is greyed out, it means that the product is not available for that date or it has passed the cut-off time.
The cut-off time are as follows:
Classic cakes:Orders must be placed 2 days before (e.g. order by Tuesday, 2359 for Thursday). A cut-off time of 12PM applies to Sundays.
Customised Cakes:Orders must be placed 2-7 days in advance. You may utilise our filter at the sidebar to filter cakes out by the number of days notice needed.

Yes we do provide 6 gold candles and a disposable cake knife upon request. Feel free to write in to us if you wish to request for a photo of these items.

We are not halal certified at the moment, but we strictly do not use any pork, lard, or alcohol products in our entire kitchen. Gelatin used, if any, is halal certified.

Yes, we do accept credit cards for all online orders.

  • You may specify a 1 hour time slot for the cake to arrive, starting from 9AM.


We're not liable for deliveries. Kindly self collect as much as possible.
For deliveries to hotels, shopping malls, and other restricted zones, the cake would have to be strictly collected from the main lobby or nearest pick up point by default. If you wish for delivery directly to the room or restaurant, please write in to inform us. A surcharge of $5 (excludes GST) would apply.

All orders are arranged to arrive within the chosen time slot. We cannot arrange the delivery to arrive at, by, or after a specific time (eg. at 2pm). Drivers deliver to a few places in one trip following a route that is carefully planned, arranged, and optimised.

However, factors that affect or may cause early arrivals or delays in deliveries (non-exhaustive):

  • The availability of drivers.
  • Traffic conditions.
  • Weather conditions.
  • How long a driver is held up at a certain delivery location.
  • Unforeseen circumstances.
  • Circumstances beyond our control.
  • Adverse weather conditions (including but not limited to heavy rains, storms, floods, and typhoons).

In such events, our delivery partners may not be able to deliver orders on time and long delays may occur. This is outside of our control. Fieldnotes will not accept responsibility for late delivery of orders and no refunds or re-deliveries will be initiated.

Buyers are advised to select a time slot with these possibilities taken into account. We do not help to ensure that recipients are home before delivering the order. Buyers need to ensure that the recipient will be home before selecting a date and time on our website and proceeding with the order.

While we try our best to arrange orders to arrive within the chosen time slot,Fieldnotes will not be held responsible for any early arrivals or delays of delivery due to any of the reasons above or because of any circumstances impacting the availability of the 3rd party drivers we use and anything else outside of our control. Please opt for self-pickup or select an available earlier/later time slot if you cannot risk the items arriving earlier or later than a chosen time frame.

Our deliveryman would call or text you if no one answers the door upon delivery. Please ensure that you are contactable and have arranged for someone to receive the cake. A 10 minute waiting period will apply. Failure to do so would result in the cake being brought back to the studio. You may choose to self collect or opt for re-delivery ($10 before GST, and subjected to availability).

Do ensure that the person is aware of your invoice number and your full order details and specifications as the cake has to be signed off to acknowledge upon receiving.

No, we do not attach any receipts with the delivery. Only a physical copy of Delivery Order (DO) will come with your order but no prices will be stated.

Storage and Cake Care

  • Cream Cakes/ Vegan/ Sugar Free Cakes: Refrigerate till just before serving. Refrigerate within 1 hour after collection.
  • Customised Cakes: Can be left in a cold air-con room for up to 2-3 hours (depending on how cold the room is). Elsewise, it would need to be refrigerated. If refrigerated, let it come to room temperature by leaving it out at least 2 hours (air con)/ 1 hour (non air con) before cake cutting to ensure a soft cake.
  • It is the customers' responsibility to ensure that the venue has proper storage for the cake. If you need information on the cake box size, or any other details to ensure proper storage, please do not hesitate to ask the team for assistance. We would not be held responsible if the venue does not have proper conditions to store the cake.
  • If your cake contains fondant pieces or sugar decorations, we will pack the fondant pieces which can be self placed easily separately for you. However, do note that there are some pieces that cannot be packed separately. Hence, as much as possible, please collect your fondant/sugar decorations cake as close to cake cutting time as possible and keep the cake in a cold air-conditioned room for up to 3-4 hours at most as not all pieces can be self-removed, and if refrigerated, might melt or form a sticky glossy exterior due to Singapore's humidity.
  • If unsure if there are fondant pieces on your cake, or if we would be packing them separately, please check with our team and we would be more than happy to assist you. It is the customer's responsibility to clarify this with the team.
  • Our customised cakes are in boxes but do not come with plastic bags. Please hold them from the base of the cake box only and not from the sides of the box.
  • Standard candles and plastic cake knife are provided if requested.
  • We do not provide dry ice or ice packs.

Desserts Care

  • Our desserts would come with plastic bags.
  • Our desserts are best eaten cold, but can be left in a cold air con room for 2-3 hours.

Our cakes are best consumed on the day itself as we use all-natural ingredients. To ensure freshness, we recommend you store the cake slices in air tight containers for at most 2 days after cake collection.

If your cake contains fondant pieces or sugar decorations, we will pack the fondant pieces which can be self placed easily separately for you. However, do note that there are some pieces that cannot be packed separately.

Hence, as much as possible, please collect your fondant/sugar decorations cake as close to cake cutting time as possible and keep the cake in a cold air-conditioned room for up to 3-4 hours at most as not all pieces can be self-removed, and if refrigerated, might melt or form a sticky glossy exterior due to Singapore's humidity.

If unsure if there are fondant pieces on your cake, or if we would be packing them separately, please check with our team and we would be more than happy to assist you.

Do kindly note that this cake uses a dark coloured frosting and might leave some stains on teeth and skin. Please rest assured that the food colouring used is food grade safe. If this is a concern for you, we would recommend opting for other cake designs if possible.
